1. Agreement
These Terms of Use (“Terms”) are an agreement between you and Race to the Gates (“we,” “us”), which operates racetothegates.com (the “Service”). By creating an account, joining or running a league, or otherwise using the Service, you agree to these Terms. If you don't agree, don't use the Service.
2. Who can play
You must be at least 18 years old and able to form a binding contract. You may only use the Service where doing so is legal for you. One account per person; keep your sign-in details secure and tell us if you think your account has been misused.
3. What Race to the Gates is
Race to the Gates is a game for entertainment. Players draft public figures and earn points, based on publicly reported information, if a drafted person dies during the season. It is a prediction game about public information and nothing more. It is not intended to mock, celebrate or wish harm on anyone, and no drafted person is affiliated with or endorses the Service.
4. Absolutely no harm, threats or contact
You agree that you will not, under any circumstances:
- cause, attempt to cause, help cause, encourage, plan or wish for the death, injury, illness or harm of any person;
- threaten, harass, stalk, intimidate or contact any person in connection with the game, including drafted people, their families, friends, staff or representatives;
- share anyone's private information (home address, medical records, location and the like) or encourage others to find it;
- interfere with anyone's medical care, safety or security;
- use the Service, its data or your league to plan, coordinate or celebrate any of the above.
Any death caused or contributed to by a player, a player's associate, or anyone acting at a player's direction earns no points, and that player will be removed permanently. We will report credible threats or attempts to harm anyone to law enforcement and will cooperate fully with any investigation, including by sharing account information.
5. Money, buy-ins and prizes
The Service is free to use. We do not collect, hold, transfer or pay out any money, and we do not take a share of any buy-in or prize. Buy-ins, pots and payouts shown in the app are a record-keeping convenience that commissioners maintain for their own leagues. Any money exchanged between league members is a private arrangement among them, outside the Service, and each member is solely responsible for making sure it is legal where they live (including any state laws on gambling or fantasy contests). We are not a party to those arrangements and are not responsible for disputes, unpaid amounts or taxes.
6. Commissioners and leagues
Commissioners create and run their leagues: rules, members, confirming deaths and settling disputes. Their decisions within the app are final for their league. We may step in, change scores or remove content or leagues when needed to enforce these Terms, but we don't referee disputes between members.
7. Information, data and AI
Scores and suggestions use public sources such as Wikipedia and Wikidata, and some features use artificial intelligence to summarize public information, including documented health conditions and how someone died. This information can be incomplete, out of date or wrong. It is provided for the game only and is not medical, legal or factual advice about anyone. Commissioners can correct dates, deaths and methods for their league. Report mistakes to us and we'll fix them where we can.
8. What you post
You're responsible for what you add to the Service, such as team names, icons and celebrities you enter by hand. Don't post anything unlawful, hateful, harassing, sexually explicit, or that infringes someone else's rights, and don't add private individuals as “celebrities.” You give us a non-exclusive, royalty-free license to host and display that content to run the Service. We may remove any content at our discretion.
9. Premium features and donations
Some features may be offered as paid add-ons, on terms shown when you buy them. Donations are voluntary gifts to help cover hosting and service costs. They are not payment for anything, are non-refundable, and are not tax-deductible.
10. Suspension and ending
You can stop using the Service and ask us to delete your account at any time. We may suspend or end your access, or remove a league, if you break these Terms, if required by law, or to protect anyone's safety. Sections 4, 5 and 11 to 15 survive the end of your account.
11. No warranties
The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including accuracy, availability, fitness for a particular purpose and non-infringement. We don't promise that scores, notifications or data will be correct, timely or uninterrupted.
12. Limit of liability
To the fullest extent the law allows, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost money, profits or data, arising from your use of the Service, any league, or any arrangement between players. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim or US $50.
13. Your responsibility to us
You agree to defend, indemnify and hold us harmless from claims, losses and costs (including reasonable legal fees) that come from your use of the Service, your content, your league's money arrangements, or your breaking these Terms or any law.
14. Governing law
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-law rules. Any dispute will be brought only in the state or federal courts located in Virginia, and you consent to their jurisdiction.
15. Changes and contact
We may update these Terms. We'll post the new version here with its effective date and, for significant changes, ask you to accept them again. If any part of these Terms can't be enforced, the rest still applies. How we handle your information is described in our
Privacy Policy. Questions:
